The government has a positive impact on economic sustainability because it strives to stabilize the economy by forming a positive reliance within the financial industry. When financial institutions have failed, they tend to turn to the government for help. It is very difficult for the economy to be fully functional without some kind of governmental assistance. How the Large Got/Stay Large In the beginning, all beers were craft beers, until the big three companies wanted to grow, and grow they did. Unfortunately, as the three largest beer companies in the United States grew, the beer-drinking public that was buying their beer were actually the people who were suffering. The reason that I say this is because of the way the large beer manufacturers got to this point. The large beer manufacturers were not very concerned about the quality of their beers as much as they were about the number of sales that were created. The way that the large beer companies did this was through their advertising campaigns. The large beer companies were/are millions and millions of dollars during different sporting functions and on every day television. Beer Wars told us that, on average, there is about $1. 5 billion spent on advertising by the large beer companies every single year. That number is astounding to me, considering how popular their beers are. I think if they were to cut back their advertisements by about 50%, they would still maintain a stranglehold on the beer market in the United States. Another way that large beer companies tend to stay on top of the market is through shelf space at different locations. The large beer companies tend to make many different varieties of beers and thus are afforded more space on the shelves and local markets and liquor stores. This leaves a very small area for craft beers to be displayed, especially when it is very difficult to determine if a beer is a craft beer or made by one of the large beer companies. I will talk more about this later in the discussion. Why Light is King The large beer companies tend to market light lager beers, and for good reason. About eighty-five percent of the beer consumed in the United States is light lager. So, Miller Lite, Coors Light and Bud-Light are very good money makers for the large beer companies. I would not blame the companies for pushing and selling what the people want, or is this what people want? Craft Beer Facts Well, craft beers haven’t fully caught on in the beer markets. NPR. org tells us that craft beers only make up about five percent of the total beer market. According to NPR. org, there are currently over two thousand breweries in the United States. Of those two thousand, about 1,950 of those breweries are considered craft beer breweries. That’s another very interesting point. Ninety-five percent of the breweries in the United States are brewing about five percent of the beer that is sold in the United States. That really doesn’t seem right, but NPR. org goes on to tell us that in order to be a craft brewery, the breweries cannot brew more than 6 million barrels of beer every year. According to texaswatchdog. org, Anheiser-Busch alone brewed over one hundred million barrels of beer in 2011. That is an amazingly large amount of beer for one company to sell. This also tells us that the hope is not nearly lost for craft brewers. If all of the 1,950 craft brewers produced only ? million barrels of beer each year, they could easily cripple the large beer manufacturers with an influx of 975 million barrels of beer flooding the marketplace. But, the vast majority of craft brewers would never want to do that. The Craft Beer Way The craft brewers in the United States and around the world have a completely different take on what it means to brew beer. Dogfish Head craft beer was said to only have . 0002% of the market share of beer sales in the United States. According to brewersassociation. org, Dogfish Head craft beer ranked 12th in the nation in 2011, based upon the number of sales for a craft brewery. However, the owner of the company said that he would never want to grow like the large beer companies have. He is more concerned about each and every bottle of beer being the best beer possible, rather than worrying too much about how many cases he is able to send out the door. As a whole, craft beer makers try to capture their piece of the market through differentiation of their products and not through advertising like the large beer companies. Craft beer makers still try to do new and interesting things with beer, but they do their best not to lose focus on the most important factor, a good quality brew. Spreading the News Beer Wars told us that one event that allows craft breweries to get their name out to the public is the great American beer festival. This is an event where brewers go to from all over the world for people to sample and try different beers that the craft brewers make. This is a great way for the small breweries to get their name out to the market. Unfortunately, Beer Wars told us that even the large beer companies are starting to attend this event. Large Feeling the Effects The large beer companies have now started feeling the effects of small craft beers in the marketplace. According to brewerassociation. org, craft brew beer sales have increased from about one percent to about six percent of market share in the past fifteen years. This is the only portion of the beer industry to have any sign growth in that timeframe. Once again, the large beer companies are using their financial advantage to combat this trend. Anheiser-Busch has gone out and purchased several small beer company names and have been selling them as craft beers, where in fact they are mass produced at one of many Anheiser-Busch’s factories. Another way that large beer companies are flexing their monetary muscles is through lawsuits. Beer Wars described how one craft brewer was being sued by Anheiser-Busch for using a name that the brewer had used for years. The problem with this is that Anheiser-Busch had not been using that name for very long. Another issue with this is that craft brewers do not have the financial means to be able to hold off many lawsuits from large beer manufacturers. The reason that this is difficult for craft beer makers is the fact that funding for craft breweries is very hard to come by. Usually investors either invest in very large ventures or very small ventures. Most of the time, craft beer makers are somewhere in the middle as far as their funding needs go. Because of this oddity, gaining funds for the production facilities for a craft brewery is very hard to obtain through normal financing. Political Issues Some of the other challenges for the craft beer manufacturers is found in Washington, D. C. Beer Wars tells us that beer lobbyists are one of the most powerful group of lobbyists in Washington. The main focus of these lobbyists is ensuring that the three-tier system of distribution is held intact. The three-tier distribution system basically splits up the beer manufacturers, the beer distributors and the beer retailers. This rule was put in after prohibition to make sure that beer sales would be fair across all persons involved. Basically, so the large beer makers couldn’t prevent others from getting their product onto store shelves. Unfortunately, this is exactly what is happening. Distributors tend to lend favor to the large beer companies, because they are paid by how much beer they deliver, and as we saw from Beer Wars, the large beer manufacturers still control that volume of beer sales. So, when the distributors are putting the beer on the shelves of the retailer, they will basically give the large beer companies whatever kind of shelving presence that they desire, basically because they are getting incentivized to do so. I definitely think that the three-tier system needs to be looked at and revamped to meet the needs of today’s marketplace. Conclusion Overall, this documentary was a very interesting look into the beer manufacturer marketplace. I never realized before how devious the large beer manufacturers are when it comes to protecting their market share. With both the lawsuits over naming rights and the basic control of beer distributors, it’s amazing that any craft beer makers even stand a chance of holding any portion of market share. I believe that the large beer manufacturers are scared of what could happen very quickly if they do not do something to respond to the expanding requirements for quality beer in the marketplace. This documentary definitely made me change my mind on how I thought about craft beers. I always figured it was just some fad that would eventually fade away. I see now that this is not the case at all. Craft brews are just being produced to give the marketplace a much higher quality, even if they have to pay a little more. I have a much greater respect for craft beer manufacturers. I would hope to someday be able to brew my own beer just to see how fulfilling it can be. Carefully analyzing the decision one is about to make with incorporating others opinions assists one in reducing the likelihood of consequences. Young adolescents of the present day are making decisions of which they have not thought thoroughly, and its effects are shown well in Gina Higgins poem, Hash for Cash. Similarly as shown in the illustration of the two obese boys, parents often make choices for their children that they think are the best for them but they are entirely the opposite. Decision making from only one point of view is adequately shown in the William Shakespeare’s play, Romeo and Juliet because in love one should not lose one’s senses of what is logical and what is completely obtuse. It is vital for an individual to cautiously consider one’s options as choices include consequences. All throughout one’s life an individual will make decision that at first seems perfect but in the long run one will abruptly approach the penalties in the future. With colossal amounts of information for young adults regarding issues that these individuals face in their everyday life, it is hard to comprehend why they are still making unwise choices. The poem, â€Å"Hash for Cash† (Gina Higgins) exceptionally portrays a young adult who is â€Å"stoned to the eyebrows† (Hash for Cash) because he or she has chosen to do drugs and irresponsible alcohol usage. These individuals may have heaps of excuses for why these individuals first got involved, but ultimately it was in their hands to refuse the urge of experimenting this new substance. The reason being that they knew about its consequences ? that would later take is in command of the person’s life. Subsequently â€Å"studies seem a waste of time†(Hash for Cash) and alas for most of these individuals, â€Å"reality [becomes] startling†(Hash for Cash) and the age where they were supposed to start living their life ? t abruptly ends due to the impractical mistake these individuals had selected to make earlier in their years. These adolescents’ lives could have taken a different route if they had thought twice about the decision they were embarking to make. If they parents had taken that moment in time to initiate the problem their child was going through these young adults may have had a brighter future. It is evident that a child is who he is from his or her s urroundings; especially his parent(s), and until that child is of ‘age’, decisions are made for him, particularly in the dietary department. The two obese children that are exposed in the illustration impeccably show the consequences that the children have to face, for the reason being that the parent(s) had not decided to consider the healthy alternative. Unfortunately the two boys in the photograph are having their childhood snatched away from them, because the food that they are consuming will cause them to comprise various health problems, such as Type 2 diabetes, heart disease, cancer, and many others. Ronald McDonald, the trademark for the company is shown to be sitting outside and enjoying the fresh air while these children are inside consuming an unhealthy diet, and pointing for more. In addition Ronald McDonald is not an obese man, unlike the children; therefore the company McDonalds is sending a hypocritical massage to the public about the affects of consuming Mcdonalds products. Thus, with all the information that is available the parent(s) of these children should have been able to make a logical decision about the food that they are going to be providing for their children. Just because the idea of it appeared appealing and one was in such haste, one should not make such a huge decision about their life without the reconsideration of its alternatives. The notorious Romeo and Juliet had made a decision that; alas lead to their demise. â€Å"A pair of star-cross’d lovers†(Romeo and Juliet) they were madly in love with each other, because they were both in love with the idea of having a companion for life. At the mere age of thirteen Juliet had already had a perspective about marriage and it was that, â€Å"It is an honour that I dream not of. (Romeo and Juliet) Likewise for Romeo for the reason that he had just recently gotten rejected from the women he had ‘loved’ before Juliet. After their first meeting they had already planned to get married, without anyone else’s input and support, clearly showcasing that they had not thought ahead of the consequences they would have to endure. This rushed process lead to several mis communications and hurdles, between Romeo and Juliet’s families and themselves. Romeo’s decision had caused the mortality of this childhood companion, Mercutio in a battle and his mother, Lady Montague because the â€Å"Grief of [her] son’s exile hath stopp’d her breath. †(Romeo and Juliet) These two lovers had helpers, which aided the two of to come together; Juliet’s Nurse and Friar Lawrence. These helpers were both of age and wise but the only incentive they had of helping Romeo and Juliet was because it might â€Å"turn [the] households’ rancour to pure love. †(Romeo and Juliet) If Romeo, Juliet, the Nurse and Friar Lawrence had clearly thought through and looked at the possible consequences, than more than Romeo and Juliet’s lives would have been saved. In love one might make wrong choices but they can be preventable, by just assessing through and ‘reading the fine print’ of the decision one is about to make. Likewise for parents, for the reason being that they should analyze the choices they are making for their children, because in their perspective it might be wiser but in the future it can become a heavy burden. Young adults are only a couple of years away from the world of adulthood, and the choices they make now, will greatly affect them in ever aspect of their life in the future. Thus one should look ahead into the future to the consequences of the decisions they are about to make so they can ask for aid and prevent it. This is very much shown with the community centre project in New York City, which happens to be a couple of blocks away from the site of the horrific events of 9/11. They people who had embarked on creating this centre with a mosque built in had not thought of the response they were going to get and the consequences that are going to be endured by everyone who is either Muslim or someone who is against the construction of the centre. If the people who had thought of this project and had considered of the consequences that they would have to undergo then people in the United States would not have been divided by distinctive religious beliefs. It is established under Article 7 of the United Nations Charter. It is charged with the responsibility of maintaining international peace and security. It derives this power under Article 24 of the Charter. In order to achieve this primary aim, Article 25 provides that it shall have enforcement powers so that it can in some situations make binding resolutions to which member states shall give effect. There are various methods through which the Security Council can maintain international peace and security under the Charter. These are: To investigate any dispute or situation which might lead to international friction; To recommend methods of adjusting such disputes or the terms of settlement; To formulate plans for the establishment of a system to regulate armaments; To determine the existence of a threat to the peace or act of aggression and recommend what action should be taken; To call on members to apply economic sanctions and other measures not involving the use of force to prevent or stop aggression; To take military action against an aggressor; The Security Council held its first session on 17th January, 1946 at Church House, London. Since its first meeting, the Council which exists in continuous session has traveled widely holding its meetings in many cities such as Addis Ababa, Ethiopia in 1972, Panama City, Panama in 1973, then at its current home at the United Nations Headquarters in New York City. {The Council is organized in such a way that it is able to function continuously and a representative of each of the members must be present at all times at the United Nations Headquarters. } The presidency of the Council rotates monthly, according to the English alphabetical listing of its member states. The Council is composed of 15 members of which 5 are permanent members with veto powers and the other 10 non permanent members are selected from the General Assembly on a rotational basis. The non permanent members are selected based on each members contribution to the maintenance of international peace and security and equitable geographical {distribution.} The non permanent members have no veto power. This is probably due to the nature of its role and the need to act expeditiously in situations of crisis which could endanger international peace and security. With the veto, the 5 permanent members can greatly influence a final decision in the council. This is due to the fact that e ven though the non permanent members can take part in the discussions and probably make suggestions, a permanent member can veto a decision that it is not happy with. This is exemplified by the case of Russia during the Cold War (show example) .The rationale for the veto is due to the fact that the mistakes made with the League of Nations needed to be avoided. There was therefore a need to have few members who would be able to take decisions expeditiously. Articles 24 and 25 of the Charter are the main source of the power of the Council. This gives the Council the leverage to act on behalf of members of the General Assembly and to trust its decision on determining when there is a threat to peace and security. This shows that invocation of Chapter VII powers is not absolutely necessary to give the Councils action a binding character. This is in consonance with the International Court of Justice holding in the Namibia case that the resolution was binding even though its basis is not the Councils chapter VII powers . During the Cold War, the Security Council was deadened by the constant use of the veto by the permanent members especially Russia which at a particular time led to the transfer of the Councils power to the General Assembly and the Unifying for Peace Resolution was adopted. With the end of the Cold War, the Security Council became more active, that is, it had more opportunity to act by adopting a lot of resolutions (the resolution on Namibia) and performing the functions for which it was established. With this development, many countries began to assert their dissatisfaction with the unrepresentative character of the Council and its exercise of power In interpreting the relevant Charter provisions on what constitutes a threat to peace and security, the Council has taken a liberal path so that a whole lot of issues come under what constitutes a threat to the peace from issues such as diseases, lack of economic co-operation to nuclear weapons. This has however come under a lot of criticism that the Council is making a general statement or more precisely legislating by making pronouncements on HIV. The reason why the Council has given its chapter VII power a liberal interpretation is due to the fact that each organ within the United Nations determines its own power to suit its functions. Similarly, the decisions of the Council are not subject to judicial review by the principle judicial organ of the United Nations which is the International Court of Justice. It is also very important to take cognizance of the fact that the Charter has to be reflective of modern challenges. It cannot continue to be interpreted in accordance with the intention of the drafters. In order to give effect to its aims and objectives, contemporary challenges have to be taken into consideration. AIMS AND OBJECTIVES The issue of what constitutes a threat to international peace and security and the steps taken by the Council to address the issues through recommendations and resolutions will form part of the aim of this research. It would be argued whether or not the Security Council makes laws or it merely interprets them. If it makes laws, its legitimacy is to be questioned, that is whether it follows due process of treaty making or legislates in accordance with the primary objective of the Charter of maintaining international peace and security. I would also consider whether it is the right forum for such law making considering the implications of its legal output on the members of the United Nations. The research will carry out a literature review on what obtains about its law making powers which makes it quite interesting considering the fact that the Security Council is a political organ. This is due to the fact that it is one of the few organs aside the World Health Organization (WHO) and the International Atomic Energy Agency (IAEA) that make binding decisions on member states. It will be argued that the council does actually make laws even if it previously didnt do so considering its recent resolutions such as the resolution on terrorism and the resolution establishing the International Compensation Commission following the Gulf War and the sanctions on Iraq considering their long term implications. Even though the Security Council has become sort of a global legislature for the reasons stated above, for the arguments that would be canvassed in Chapter 2 of this dissertation, it will be argued that the Security Council being a political organ is not the right forum for law making as the case maybe. Due to the fact that there is no legislature at the international level, it became the ultimate world authority even though its primary pre-occupation is the maintenance of international peace and security. The word peace and security being viewed in the positive rather than just the prevention of war can encompass any subject and thus comes within the jurisdiction of the Security Council to legislate upon. (talk about hegemonic international law) DOES THE SECURITY COUNCIL MAKE LAWS? The Security Council as an organ was not established to make law. (See Chesterman).Its primary role as stated earlier is the maintenance of international peace and security, a term which was couched in the negative by the drafters of the United Nations Charter i.e. to prevent war. The passage of time has affected the Charter and brought about different events to which solutions had to be proffered and thus the need for a liberal interpretation of the Charter in order to give effect to its aims and objectives. It is the manner the Council has chosen to interpret the Charter that has led to debates about whether it has started legislating(szazs) or it merely interprets the provisions of the Charter through its resolutions and recommendations.(see alvarez,pages 129,141,143). As stated earlier, the Security Council is one of the few organs aside the WHO and IAEA that actually make legal instruments that are binding on the members. Although some resolutions are recommendatory while others are binding and has been accepted by states by virtue of Article 25 of the charter, recent resolutions have not only been binding but have sparked debates as to whether the council has started legislating. Different opinions abound with regard to this present debate. White (2005) is of the view that the Council has developed a quasi-judicial capacity despite its express power of determination being limited to Article 39 of the Charter. He terms it as judicial capacity due to the fact that the determinations are based on international law rather than institutional law of its constituent document. He further contends that such a power is invaluable in a legal system that depends for its continuance on clear and unequivocal condemnation of breaches of international law. Although his opinion holds true to some extent due to the fact that there is no legislature at the international level, what it doesnt tell us is the implications of such law making by the Council. Schrijver (2006) is of the opinion that of recent the Council had started to create law by virtue of the general statements that it makes. That with resolution 1540 (resolution on terrorism), the Council had taken an unprecedented step of bringing into force legislation binding on all states on the issue of terrorism (szasz-the Security Council starts legislating). This argument contends that even if the Council before now did not create binding obligations on the members of the United Nations, its resolutions have taken a new dimension and they have the effect of law at the state level. Others are of the opinion that the changing role of the Council as a result of the transformation in international law through the 20th century has caused a shift from bilateral treaty relations to multilateral institutional framework. In essence the consent of states are no longer required before action can be taken putting into consideration the matter of which the Council has jurisdiction over, hence the need to legislate on behalf of the entire international community. This argument is in line with the need to interpret the Charter in light of its object and purpose in accordance with Article 32 of the Vienna Convention on the law of treaties. However, there is the need for such laws when the need arises for them to be made in accordance with the limitations set by the Charter which will be explored further in the chapter taking the case study of the sanctions placed on Iraq during the Gulf conflict. Chesterman opines that for the Council to become a world legislator there is the need for a conscious transfer of such power from the member states to the Council to elevate it to that status. Another justification for the Councils recent role could be supported by the fact that there is no specified organ in the Charter responsible for interpreting the provisions of the Charter. As a result of this, each organ is responsible for interpreting the Charter provisions relevant to its functions. Similarly, since the Council is charged with the responsibility of determining what constitutes a threat to international peace and security, (check relevant charter provision).it is justified in doing what it is presently engaged in. The ends driven demands of peace and security are winning the battle for the Councils role It is contended that the Council by answering purely juridical questions to which it is not the rightful organ, has shed its reluctance to create legal obligations, thus acting as a law maker .The legality for its law making powers can be found in the provisions of its Chapter VII powers and states consequently have a duty to obey its determinations A different opinion holds that since there is no enforcement mechanism at the international level, the international normative system is not law. Therefore, the decisions made by the Council are not legislative in nature. (Check the article and see her reference on this point). Although this is a good point due to the fact there is no legislature at the international level, it does not take cognizance of the fact that the present day Security Council does actually have the ability to coerce compliance and has done so in several instances such as during the Gulf War when it required member states to use all necessary means to ensure compliance by Iraq of the order to vacate Kuwait. (find reference) It has also been contended that the sanctions that the Council places on states are temporary and meant to secure compliance and as such cannot be said to establish new rules of international law. This a plausible argument due to the fact that even if the sanctions were initially temporary, they can later acquire the force of law to be made applicable to other defaulting states, hence they become custom (my argument is plausible as well). It is submitted in line with Chestermans argument that the Councils decisions even if previously not legislative, have taken a radical turn for imposing obligations on states. This is true of the resolution on terrorism which requires states to pass legislations to give effect to the resolution and report to a committee about progress made on the implementation of the resolution (see szasz and the resolution on terrorism).This is in contradiction to most of its resolutions which usually encourage states to do a particular thing rather than using operative words likeshall. This kind of obligation is usually found at the state level where you have a legislature with the requisite power and the necessary checks on its decisions or at the international level through multilateral treaties that create obligations on states with their consent. More so, this is contrary to the practice of the General Assembly where resolutions of this nature are adopted unanimously. The Security Council is supposed to work in conjunction with the General Assembly in relation to security matters (correction needed). BINDING AND NON BINDING RESOLUTION The Security Council takes decisions by passing resolutions. Resolutions may be defined as a unanimous agreement by the members of the Security Council on the course of action to take with regards to issues of international peace and security. The Security Council is one of the few organs with intergovernmental organizations that can adopt binding resolution on member states. Pursuant to the provisions of Article 25 and 48(1) of the charter, the council can adopt binding decisions on its members. For the decisions to be binding, they must be taken in pursuance of the primary responsibility of the Council of maintaining international peace and security. The binding resolutions usually require compliance by states and it can come in the form of economic sanctions or other restriction on the state in question (szazs). On the other hand, the Council has recommendatory powers in accordance with Article 26 of the Charter by formulating plans to be submitted to the members of the United Nations through the General Assembly. Such plans are not binding on the member states (Stefan talmon) In determining whether a resolution is binding or not, the International Court of Justice in the advisory opinion over the continued presence of South Africa in Namibia stated that care ought to be taken before reaching a conclusion. White is of the opinion that the approach of the Council means that it can adopt binding decisions on a wider variety of matters concerning peace and security (within its confines). A possible explanation for the cautious approach of the court might be due to the fact that distinction between binding resolutions and mere declarations have become blurred (Alvarez).This is as a result of developments in international norms. What is today merely of normative value might acquire the force of law with time and might even develop into a jus cogen norm (define term in glossary).This could be seen with some General Assembly declaration (declaration on the right of self determination).This could possibly happen with the resolution on terrorism. White says that the non binding recommendations can help shape customary international law. This is because the distinction between binding resolution and soft law obligation as stated by Alvarez is no longer clear cut (page 599).Soft law is no longer just a precursor to a hard rule. It is sometimes regarded as preferable to law making. It helps to provide an authoritative interpretation of the Charter as can be exemplified in the case of the council. With the end of the Cold War, the activities of the Council have made distinction between enforcement, law making and dispute settlement difficult (page 600). At one time or the other, the Council has engaged in all of the above mentioned activities and even though they were not initially meant to be binding, states eventually adopt legislations to that effect (find example).

Medea and Hedda Gabler Essay -- Theatre

The materialistic wants of people often lead them to act in imprudent ways. This is especially true in the cases of Jason and George Tesman, main characters from the plays of Medea and Hedda Gabler, who display the folly of blindly adhering to aesthetic standards. (In this essay, an aesthetic standard is the placement of value on worldly goods and sensationalistic feeling). Acting on such a standard creates a tunnel vision that limits one’s thoughts and prevents one from seeing anything other than that which is directly beneficial. This tunnel vision inhibits Jason and George Tesman from perceiving reality as it is and holds them captive to their own specious view of events. Furthermore, it negatively affects their lives as well as those of others. As seen through the characters of Jason and George Tesman, aesthetic standards can lock one’s mind into a box with no key. The play Medea opens with the revelation that Jason, a Greek explorer, has left his wife Medea for another woman. This infidelity is the primary example of Jason’s distorted principles and symbolizes the strong influence aesthetic standards have over his life. One needs only to read Jason’s debate with Medea to understand Jason’s blindness. While on his quest for the golden fleece, an event that occurred prior to the play, Jason sought Medea’s help to vanquish obstacles that impeded his wanted goal. When Medea mentions this incident during their dispute, Jason replies: â€Å"My view is that Cyprus was alone responsible of men and gods for preserving my life. You are clever enough-†¦but on this question of saving me, I can prove you have certainly got more from me than you gave† (Euripides 17). Jason is so overcome by his own emotions that he stoically believes a lie to ... ...esman’s failure to recognize Hedda’s devilish character, there is not even a manuscript acknowledging the life of Eilert Lovborg. This can all be attributed to the fact that George was subject to whimsical emotional desires. The blinding power of aesthetic standards is a defining, if not clearly visible, theme in both the plays of Medea and Hedda Gabler. Both the authors, Euripides and Ibsen, bring the subject to a new light through the characters of Jason and George Tesman. Although the plays were written for people of a certain era, their message is timeless. A Journal of the Association for Psychological Science, Vol 20 No 4, 516 – 522.There are numerous strategies used by students for learning and recalling information from various sources of educational texts. The paper (Mark A. McDonald, 2009) provides evidence why the study strategy; 3R Read-Recite-Review produces mnemonic benefits that exceed those of note-taking and rereading. Two experiments were conducted, students were instructed to learn specific pieces of text using either; reread only (control group), read and take notes (control group) or follow the process of the read-recite-review strategy.The effectivene ss and efficiency of the study strategies were assessed by timing the time taken to complete the reading process and by comparing the results of immediate and delayed testing which utilised free call, multiple choice and short answers to check the amount of information retained. Experiment 1 required students to read factual, simple and short passages which proved that the 3R strategy was more effective using free call of information both immediately and delayed, however these benefits did not show in the results for both multiple choice nd short answer tests. Experiment 2 involved students reading longer and more complex passages, results supported those found in experiment 1. Additionally the second experiment found 3R beneficial over rereading for both multiple choice and problem solving. The results from both experiments concluded that the 3R strategy may promote a deep learning of materials, having benefits beyond improving retention. The study clearly demonstrated that the 3R strategy is an efficient and effective study strategy when used in a controlled laboratory setting.However, the study was unable to establish if the motivation level of students would weaken the processing benefits of the strategy. As Daniel, Howard and Einstein state if learners are in a more motivating setting and consequently are more conscientious in their study activities, would the effects of 3R be attenuated? The experiments were performed using psychology students who participated either as part of a course requirement or for money, however students in all fields of study utilise study strategies.The motivation of students is again questioned as the I believe the personal benefit would be greater in a real life setting as opposed to receiving a monetary value to participate with no personal impact from the result achieved. Therefore I think the study should be repeated using a range of students from various courses/fields of study, using more real life motivators. In additio n, I suggest testing the 3R strategy using spaced presentations of learning materials as opposed to information being presented in one sitting in order to test the effectiveness on longer term retention.

The purpose of the Equality Act 2010 is to codify both international and local laws such as such as the 1970 Equal Pay Act, the 1975 Sex Discrimination Act, the 1976 Race Relations Act and the 1995 Disability Discrimination Act.   In order to protect disabled people from discrimination, the Act ensures that goods and service providers, landlords and employers are endowed with the responsibilit y of making reasonable modifications to their facilities to ensure access for disabled individuals (Evans 2011, 1).  The Equality Act 2010 does, however, allow service providers, landlords and employers to implement policies and practices that guarantee effective work operations despite appearing discriminatory. Available literature indicates the effectiveness of the law in deterring discrimination.   Since 2010, the UK has been free of discrimination towards disabled people, and this is largely attributable to the effectiveness of the Equality Act 2010 (Jackson and Banerjee 2013, 181).Literature review The literature review section of this paper analyses an array of available data on the effectiveness of the Equality Act 2010 in eradicating discrimination towards disabled people since 2010.The Equality Act 2010 ensures all public and private institutions implement the rights of disabled people as enshrined in the Act, as well as the United Nations Convention on the Rights of Pe rsons with Disabilities.   Therefore, the 2010 Act is in line with this Convention on the protecting the rights of people with disabilities (Lawson 2011, 369).  The Act includes additional protection measures such as indirect discrimination.   This has enhanced analysis of disability-specific applications and offered new opportunities for debate regarding the need for greater protection of disabled people (Wallace 2011, 1).

Sellers and consumers are free to trade in any way that works for them with relatively little interference from government. Absorption spectroscopy and acetic acid The absorbance of light, wavelength 632nm, was measured in an indicator solution at varying pH, and varying concentration, allowing for a Beer-Lambert plot to be constructed. This was then used to measure acetic acid uptake at the surface of deionised water and octan-1-ol coated water, allowing pH, and hence concentration, to be calculated from absorbance of the liquid. Introduction Surfactants are molecules which are able to form a surface across a liquid, and stop the interaction of foreign molecules with the solution without interacting with these molecules first. These are extremely useful since they often contain a hydrophobic and hydrophilic aspect, which interact differently to different molecules. Surfactants are used in the manufacture of paper, textiles and construction among others.[1] They are the main ingredient of detergents and they allow non-polar molecules to dissolve in polar molecules, such as oil into water. On the surface of the liquid, the surfactant will interact slightly differently. It will create a surface of hydrophobic tails. This will stop polar molecules from entering the liquid, since the liquid will appear to be a poor solution for the polar molecule to interact with. They also increase decrease tension of the liquid.[4] This barrier is expected to stop the acetic acid, used in part 3 of the experiment, interacting with the water solvent. If it does interact, the pH of the solution will lower due to acetic acids presence, and the indicator will show a change in colour. If no acetic acid enters the solution, no change should be observed or measured. Experimental Using de-ionised water, a reference light intensity was recorded. A 250ml solution (1) of 0.005% wt bromocresol green was then prepared, and absorbance was measured. 100ml was removed, and the pH adjusted using 0.1M sodium hydroxide and glacial acetic acid, and absorbance was noted at pHs between 3-6 at 0.3 increments. 50ml of remaining solution (1) was further diluted to solutions of 0.0025%, 0.00125%, 0.000625% and 0.0003125% concentration. Spectroscopic analysis of these concentrations was made, and a Beer Lambert graph plotted. A solution of unknown concentration was then spectroscopically analysed and its approximate concentration determined. This solution was then enclosed in a container with acetic acid, and spectroscopic readings taken every 30 seconds. This was repeated with fresh solution, with the addition of 0.2ml of octan-1-ol to the surface of the cuvette. Results The results for the pH change showed a curve, going from lower pH on the left to high pH on the right. This is a more quantifiable way of showing that as the Bromocresol turned blue at higher pH. This shows absorption toward the end of the spectrum of lower energy, (ie higher wavelength). So as pH increased, the absorbance of Bromocresol at 632nm increased too as it became blue. The next aspect of the experiment was to analyse how concentration affected the absorbance of Bromocresol green. As concentration of bromocresol green was altered, it was possible to draw a Beer-Lambert plot detailing how the absorption of the light changed with concentration of the Bromocresol Green. As would be expected, there is a straight line relationship between Bromocresol concentration and Absorbance except at higher concentrations, where the solution plateaus and becomes non-linear. Excluding this end point it is possible to derive the gradient, and hence the value of ?L. This was determined to be 36600. The Bromocresol solution of unknown concentration transmitted 0.222, making a LOG(Io/I) value of 0.67. Dividing this by the gradient gave the Bromocresol solution concentration to be 4.5710-6moldm-3. From this it is possible to determine the acidity of the solution using the Beer-Lambert plot as given above. Using an original pH, it is then possible to determine the concentration of the acetic acid on top of this, using simple equations associated with pKa and pH. From the information of Ka and pH, it is possible to calculate the concentration of acetic acid in the solvent. Error analysis Using error analysis and standard errors of instrumentation used, it is possible to construct the same graphs as above but with error bars. These are shown below. Discussion The calculations and graphs suggest that coating a solvent in octan-1-ol would encourage uptake of acetic acid, rather than inhibit it. This may be due to dimerzation or trimerzation of acetic acid (1) as it evaporates from the surface, making it more soluble in the partially polar octan-1-ol solution. Single carbon-oxygen bonds display less polarisation than carbonyl bonds do, and so it is likely that in this dimerised arrangement acetic acid more readily dissolved in the oil, in addition to acetic acid readily dissolving in organic solvents. Because of these reasons it readily crossed over from the relatively non-polar octanol to the polar water solvent, decreasing the pH of the Bromocresol containing solution in both the uncoated and octanol coated solutions. It is, however, most likely that the experiment was not successful. Alternative indicators, such as NH3, would have readily dissolved in water and increased the pH of the solution. It would also not have been able to dissolve in the octanol due to the higher polarity and availability of the nitrogen lone pair. Because of this it would have been a better indicator of the presence of a surfactant than acetic acid. Acknowledgements I would like to thank my demonstrators M. The Day of Infamy :: Imagery Terror Terrorism 9/11 Essays

The Day of Infamy Erupting on a crisp September morning, terrorist attacks bring America to a standstill. As the day began, it was an average Tuesday morning and New Yorkers as well as the rest of United States Citizens had no idea that in a matter of moments their city and their lives would be changed forever. People were doing what they had done thousands of times before. Some were on their way to work; while others were sitting at their desks, checking e-mail, sipping coffee or reading the morning paper. Out of the clear blue sky an airplane was hijacked and was heading for the twin tower. People heard an approaching noise and then all of a sudden a loud explosion! The twin towers of the World Trade Center were the symbols of Americas prosperity. Dr. Stefan Pasternack, a clinical professor of Georgetown University who specializes in the impact of terrorism and murder says: Its one thing to think of a truck blowing up in front of a building. This involved the use of civilian aircraft-the imagery is much more frightening. What we see here is what terrorism is all about. The idea is to make people feel that they cannot feel protected by their government (Black Tuesday 20). With World War II being a fight for national survival, terrorism is the struggle to preserve national values and stand for what we, as Americans, believe. As president Bush stated, Terrorists attacks can shake the foundations of our biggest buildings, but they cannot touch the foundation of America (Black Tuesday 12). The attacks on our nation nearly brought America to a halt. Around the world security was tightened. Air travel stopped, businesses closed and government facilities were evacuated Tuesday morning of September eleventh. For the first time in United States history, the Federal Aviation Administration (FAA) shut down air traffic nationwide. There were many incoming flights from around the world, carrying anywhere from four thousand to six thousand passengers, that were diverted to Canada. Authoriti es shut down all the tunnels and bridges in and out of New York City. All train services were shut down and many shipping ports were also closed down. The most memorable image of September eleventh was the Twin Towers that were engulfed in smoke and flames. Over and over the Towers flashed across Television screens and on the front pages of newspapers.

High School and Students Essay

Introduction The continuous deterioration of the quality of education in the Philippines has prompted the DepEd to push for the implementation of the K to 12 programs, which entails the institutionalization of kindergarten and the addition of two more years of high school in the basic education cycle. The proposal has spurred a heated debate on whether it could lead to improvements or just exacerbate thn e present state of education in the country. The Enhanced K+12 Basic Education Program in the Philippines has been officially started. It has been initiated by the Aquino administration where students will have to undergo a new system of education. This program will require all incoming students to enroll into two more years of basic education. Thus, the K+12 System will basically include the Universal kindergarten, 6 years of elementary, 4 years of junior high school with an additional 2 years for senior high school. Moreover, the program aims to uplift the quality of education in the Philippines in order for graduates to be easily employed. The program also aims to meet the standards required for professionals who would want to work abroad. Most importantly, the system aims to fully enhance and develop the students in order for them to be well-prepared especially in emotional and cognitive aspects. Through this, graduates will be able to face the pressures of their future workplace. However, not all are in favor of the K+12 Education. There are students complaining of the additional years and there are parents who are not in favor of the additional expenses. But indeed, it is an undeniable fact that additional years in the education system will really require more budgets not just from the government but from the parents as well. Aside from this, students will need additional classrooms, school supplies and facilities. The program would need more qualified teachers as well. The researchers believe that the K+12 Education in the Philippines would uplift the quality of lifestyle of the Filipino people. But, this could not be done without being prepared. And since the program has already been implemented, what is  more important now is for students to do their best and study despite of the lack of facilities. The Philippine educational system pursues the achievement of excellent undergraduates in the elementary and secondary level. Implementation of UbD is one of the proposals that undertook in the country recently. At present, the Department of Education pronounces the addition of two more years in the basic education of students, which according to them will benefit not only the Filipino youth but all the Filipinos in the Philippines. This proposal is part of P-noy’s Educational Reform Program. The administration asserts that with the implementation of such program, the problem of unemployment in the country will be resolved. In as much as employment in the Philippines is concerned, the K12 education also responds to the fact that most countries in the world already have the same plan in their educational institutions. With this, the standards of these countries go a notch higher than what the country has, thus, creating an expansion in the global competency. What can be really said about this plan? While the reaction of the public is divided, where some are in favor and some are not, here are several issues that point out to the aggression of opposing groups especially the parents to this program. One of the main problems in the Philippines which the government needs to resolve is the lack of school and classrooms in the different parts of the country. It is important that students stay in a place that is conducive for study while they are away from home. In addition, with teachers go abroad to teach, or do another job, there is already a shortage of educators in schools that mold the minds of learners. And this deficiency has become a problem for the country in the past several years. Finally, there is a need for students to utilize the appropriate instructional materials and school equipment for them to learn and gain the necessary knowledge in school. This lack of accessibility in books and other school supplies clearly manifest the scarcity in the public schools in the country. There is nothing wrong in aiming the other fraction of a horizon, and that is what the government attempts to accomplish. It is in fact an indication that to aspire for something higher, one must carry out certain actions to achieve the goal. However, the administration also ought to realize and clearly understand what the educational system in the Philippines needs to develop primarily. The mentioned issues above are only a few elements that entailed to be resolved. At some point, the Philippines cannot go ahead unless the concerns are faced and the difficulties are completely solved. There are a lot to be done to improve the competency of the youth. The government does not need to gaze from afar. ? Such element includes the number of public school classrooms plus the adequate supply of classroom chairs, books, etc. If the government could allot a bigger budget to educational needs, then we could be one-step ahead towards the success of the K-12 program. Furthermore, parents (especially those who belong in the poor sector) should be properly informed and motivated of the advantages of the K-12 Education Plan. This is very important since parents play a major role in providing the child’s school allowances, supplies, and fees for other school projects and activities. Add to that the support of parents towards their children in terms of guidance and teaching. The DepEd seems all set to add two more years to the country’s 10 year basic education curriculum. This is a very tough issue to crack. We think it is a clash between reality and the ideal. A question unanswered – is this for the common good? The truth is there are already many problems at the current 10-year curriculum and it has nothing to do with number of years. To enumerate a few – there are not enough qualified teachers to teach all the students; that is made worst with just too many students; there are not enough classrooms and schools to comfortably fit all the students (not to mention not enough bathrooms and water supply); there are not enough books; add the problem of poor quality books, on top of that there are not enough facilities and finally very high dropout rates. The latter, high dropout rates are being caused by something out of the education system but affects large part of the population – poverty. There are just so many poor families and they are so poor that many of them cannot afford to pay for the already meager amount needed for the education of their children. Grade school and high school are free in public schools with parents needing to just spend on uniforms, fare and some expenses. The tuition which normally accounts for a very large share of the total expenses are free and yet most poor families can still not afford of what is left for them to spend. It is not that the expenses are high, it’s just their income is very, very low. It is this inability to afford the other expenses that has caused a very high dropout rate among students. This plan of the DepEd to add two more years will of course not solve any of the above problems. In fact, it will only extend all those problems by two more years. A longer basic education will also mean even higher dropout rates. Then there is the problem of additional expenses for the government. As of now, with the 10 year curriculum, there is already desperate lack of classrooms and schools. The public schools cannot turn the student’s away when they show up to enroll. To cope many public schools have crammed as many students as they can inside the classroom with classrooms crammed with chairs from wall to wall. Not enough, the schools conduct classes in at least shifts, in some instances classes held very early in the morning till late in the evening. With two additional years, the schools will definitely need to construct new buildings and classrooms or God forbid conduct classes 24/7. The above is the reality part. On the government side, in the discussion paper it disseminated during its press conference last Oct. 5, the Department of Education (DepEd) has given at least nine reasons for the K+12 project: 1. â€Å"Enhancing the quality of basic education in the Philippines is urgent and critical. † 2. â€Å"The poor quality of basic education is reflected in the low achievement scores of Filipino students. One reason is that students do not get adequate instructional time or time on task. † 3. International test results consistently show Filipino students lagging way behind practically everybody else in the world. In the 2008 mathematics exam, for example, we came in dead last. 4. â€Å"The congested curriculum partly explains the present state of education. † Twelve years of content are crammed into ten years. 5. â€Å"This quality of education is reflected in the inadequate preparation of high school graduates for the world of work or entrepreneurship or higher education. † If ten years were adequate, how come employers do not hire fresh high school graduates? How come most high school graduates flunk the UPCAT? 6. â€Å"Most graduates are too young to enter the labor force. † Since most children start Grade 1 when they are 6 years old, they do not reach the legal employable age of 18 when they graduate from high school today. 7. â€Å"The current system also reinforces the misperception that basic education is just a preparatory step for higher education. † Why prioritize the minority of high school graduates that go to college? 8. â€Å"The short duration of the basic education program also puts the millions of overseas Filipino workers (OFWs), especially the professionals, and those who intend to study abroad, at a disadvantage. Our graduates are not automatically recognized as professionals abroad. † The best examples are our engineering graduates, who are condemned to international jobs not befitting their professional status due to our not having a 12-year basic education cycle. 9. â€Å"The short basic education program affects the human development of the Filipino children. † If we believe that 17-year-old high school graduates are emotionally, psychologically, and intellectually mature, why do we require them to get parental consent before they get married? On the other hand, those opposing the plan put forward the following arguments: 1. Parents have to shell out more money (for transportation and food) for the education of their children. 2. The government does not have the money to pay for two more years of free education, since it does not even have the money to fully support today’s ten years. DepEd must first solve the lack of classrooms, furniture and equipment, qualified teachers, and error-free textbooks. 3. We can do in ten years what everyone else in the world takes 12 years to do. Why do we have to follow what the rest of the world is doing? We are better than all of them. Filipinos right now are accepted in prestigious graduate schools in the world, even with only ten years of basic education. 4. As far as the curriculum is concerned, DepEd should fix the current subjects instead of adding new ones. The problem is the content, not the length, of basic education. As an editorial put it, we need to have better education, not more education. 5. A high school diploma will not get anybody anywhere, because business firms will not hire fresh high school graduates. 6. Every family dreams of having a child graduate from college. 7. While students are stuck in Grades 11 and 12, colleges and universities will have no freshmen for two years. This will spell financial disaster for many private Higher Education Institutions (HEIs). 8. The drop-out rate will increase because of the two extra years. ? . CHAPTER III METHODOLOGY ? Chapter III Methodology This chapter deals with the methodology of the studies. This is presented on the following sections: (a) Research design (b) Sampling Technique (c) Instrumentation (d) Data-gathering procedure and (e) Statistical treatment of data. Research Method The descriptive survey method was man used in this research. The descriptive method is concerned with the analysis of the relationship between non-manipulated variable employing the use of the development of generalization. This means that variable have already occurred and are just selected and observed Fraenkel and Wallen (1998) also define the descriptive research as involving collection of data in order to test hypothesis and answer questions concerning the current status of the subject of the study. Since the study deals with perceptions of parents and high school students on K12 policy of the Philippine government academic year 2011-2012, the descriptive survey method was deemed appropriate to be used. [[[[ Sampling Technique The population of the study involved a total number if 496 respondents randomly selected representing at least more than half of the school’s population irrespective of the age, year, selection and gender. Research Instrument The researchers devised a self-made questionnaire designed to obtain information related on the objective of the study. It consisted of the following parts: Part I – This part of the questionnaire dealt with personal information regarding the respondents (name and section). Part II – This part of the questionnaire was intended to ask the respondent’s definition about K+12. Part III – This part of the questionnaire was intended to ask the respondent’s idea about the advantages and disadvantages of K12. Part IV- This part of the questionnaire was intended to ask the respondent’s opinion about the benefits of K+12. Data Gathering Procedures. The following data gathering procedures guided the researchers Phase 1 – a copy of the questionnaire was presented to the thesis adviser. The researchers asked for his comments and suggestions; Phase 2 – the researchers presented the edited questionnaire and asked for further assistance from parents. It was then presented for approval to the school principal who gave valuable insight and ideas on how best the data can be gathered. Phase 3 – the researchers conducted data gathering procedures during first week of February. The figure below is the flowchart of the Data Gathering Procedures done by the researchers. Fig. 2 Statistical Treatment of Data For analyzing the data, the researchers will be use of the following statistical tools: Percentage This refers to the number of parts per one hundred. It is a statistical tool used to express how large one quantity is, relative to another quantity. To get the total percentage of specific number and total number respondents in the questionnaire the formula is: % = F/N * 100 Where N=370 Unless otherwise stated the above formula will be used except for multiresponse questions or for gender based questions. ? Multiresponse table 3 showed that more money to spend was the top disadvantage of K12 with 79. 19% followed by waste of time with 16. 22% and lack of leisure with 15. 41% as the final point of view. ? Table 4 4. Do you agree on K12 policy? More than half of the respondents said that they disagreed on the K12 policy with 67. 57% and the remaining 32. 43% of the respondents agreed. ? Table 5 5. Do you think you will be well educated if you graduated under the K12 system? Table 5 showed that the majority of the respondents agreed that they will be well educated if they graduated under the K12 policy with 70. 27% and the other respondents left disagreed with 29. 73%. ? Table 6 6. In K12 system, do you think it will be helpful to all students? The greater part of the respondents believed that K12 policy will be helpful to the students. ? CHAPTER IV SUMMARY, CONCLUSIONS AND RECOMMENDATIONS ? CHAPTER IV Summary, Conclusions and Recommendations This chapter presents the summary of findings, conclusions and recommendations. Summary of Findings. This first table is a multiresponse item which showed that majority of respondents surveyed that they defined K12 as an added two years in high school with 77. 57% followed by it is an academic program with 20. 54% and a government policy with 15. 41%. The second table is also a multiresponse item which showed that majority of respondents surveyed said that the advantage of K12 policy is to gain more knowledge with 62. 97% followed by more chances to have work with 29. 19% and free OJT with 18. 65%. Multiresponse table 3 showed that more money to spend was the top disadvantage of K12 with 79. 19% followed by waste of time with 16. 22% and lack of leisure with 15. 41% as the final point of view. Table 4 illustrates that more than half of the respondents said that they disagreed on the K12 policy with 67. 57% and the remaining 32. 43% of the respondents agreed. With this, it showed that the most of the students doesn’t like to implement the K+12 policy due to their concern for their time and to their parent’s money.. Table 5 proved that the majority of the respondents agreed that they will be well educated if they graduated under the K12 policy with 70. 27% and the other respondents left disagreed with 29. 73%. In table 6, it shows that the greater part of the respondents believed that K12 policy will be helpful to the students. Conclusions It has proved that the respondents showed their different views or perceptions on the K-12 system of education in the Philippine government. The following conclusions have been drawn: 1. That students were all informed and yet educated what the K-12 system is about. 2. That disadvantages were showed by the majority of the students through the data gathered whereas it resulted the students not to agree on the said system. 3. That students will be well educated after finishing the K-12 system in their education. 4. And on the other side it will be a great help to the students to learn more and adequate information that will mold them into a better person. ? Recommendation It is with fervent wish of the researchers that the following recommendations be considered by the concerned; Students 1. Responsible is the key to the effectiveness of this program. 2. Should be responsible enough to fulfill the given task of their teachers. Teachers 1. Teachers should encourage their students to open up if they have their problems on their subjects. 2. Since teachers are willing to help the students be more cooperative and open-minded to develop their skills and studies. Schools 1. Schools should provide clean and green surroundings. 3. Monitor the students in having gangs/fraternities. 4. They should provide and recuperate their facilities. Parents 1. Parents should help their children in their problems. 2. Parents should encourage their children to keep not neglect their studies. ?
